Client defined as the owner and or authorized representative for Restaurants, Shops, and Coffee shops.

The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use"), govern your access to and use of our websites and applications, including any content, functionality and services offered on or through our websites, and our online applications that run on smart phones, tablets and other devices which provide dedicated non-browser-based interaction between you and our websites (all of which are collectively called our “Website"), whether as a guest or a registered user. Please read the Terms of Use carefully before you start to use the Website and applications. By using the Website and applications, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website and applications.

Persons who are under the age of 18 years of age are not allowed to use our Website and applications. Accordingly, you agree that you are 18 years of age or older and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in these Terms of Use; otherwise, please exit the Website and applications.

We suggest that you take advantage of any access controls offered through the Website and applications or third-party sites, which are designed to assist you in limiting or blocking access to certain types of web content you may feel are harmful to or inappropriate for minors.

No Alcohol Policy In the interest of keeping ByeKids App child-friendly we will enforce a strict no-alcohol policy on our app. This means that you agree to refrain from posting any F&B offers on the app that contain alcohol or market the sales of alcohol.

The sales of alcohol through our app can get your account permanently revoked. By agreeing to our terms, you agree not to hold the company liable in any way for enforcing this policy. Changes to the Terms of Use We may revise and update these Terms of Use from time to time in our sole discretion.

All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page each time you access the Website and applications, so you are aware of any changes, as they are binding on you.

We reserve the right to withdraw or amend the Website and Application, and any service or material we provide on the Website and Application, in our sole discretion without notice. No right, title or interest in or to the Website and Application or any content on the Website and Application is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the Website and Application not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark and other laws.

Trademarks

The Company name and trademarks, the Company logo and all related names, logos, product and service names, designs and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans on the Website are the trademarks of their respective owners.

Prohibited Uses

You may use the Website and Application including any Restricted Section only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website and Applications:

In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software).

The Website and Application is primarily a platform to facilitate the flow of information from restaurants, Shops, and coffee shops to potential customers.

All information shared is the responsibility of the entities sharing them. ByeKids App is not liable for any of the information shared by third parties using the service or the consequences of that information.

The Website and Application may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards and other interactive features (collectively, “Interactive Services") that allow users to post, submit, publish, display or transmit to other users or other persons (hereinafter, “post") content or materials (collectively, “User Contributions") on or through the Website and Application.

All User Contributions must comply with the Content Standards set out in these Terms of Use.

Any User Contribution you post to the Website and Application will be considered non-confidential and nonproprietary.

By providing any User Contribution on the Website and Application, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors and assigns the right to use, reproduce, modify, perform, display, distribute and otherwise disclose to third parties any such material according to your account settings.

You represent and warrant that:

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the courts of the Dubai International Financial Centre, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your jurisdiction of residence or any other relevant jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to these terms of use or the website must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

Waiver and Severability

No waiver by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

This Terms of Use, our Privacy Policy and Terms of Sale constitute the sole and entire agreement between you and ByeKids App with respect to the Website and Application and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website and Application.

Considerations for T&C:

Client defined as the owner and or authorized representative for Restaurants, Shops, and Coffee shops.

ByeKids App providing a platform for the clients to promote clients offers in individual dashboard showing the offers timing, prices, validations, benefits, contact details, location and all required information about the client and offers.
The Client and / or his representative is fully responsibility for the contents of his dashboard descriptions, which should be in comply with UAE laws and All Local Authorities regulations.
ByeKids App have the full rights to suspend the agreement on partially or permanent basis for any deviation about the laws.
ByeKids APP will not hold any responsibility against any deviations from the laws in the Client dashboard and / or his belongs.
The client shall be responsible for being correctly licensed to operate their business within the UAE.
ByeKids APP shall not be responsible for the licenses of the Client. By entering into this agreement, the Client confirms that they are licensed correctly to operate their business within the UAE.
By entering into this agreement, the Client confirms that he will sale his offers (which mentioned in ByeKids App dashboard) by allowing the users / customers whom using ByeKids App only to utilize the App to obtain the offers values during the payment.
ByeKids APP have the full rights to suspend the agreement on partially or permanent basis for any deviation about the service agreement.
This agreement will be used to promote Clients deals and offers on ByeKids APP as well as in ByeKids website.
ByeKids App Clients (Restaurants, Shops, and Coffee Shops ) will not post misguiding content on the app/ put up offers that they don’t offer a customer- doing so can get them banned from the app and or other legal action depending on the scale of consequences.
ByeKids App maintains the right to stop any Client from using their Website and Application platforms at any time following a refund of any money that has not been spent to obtain a service or access a feature.
ByeKids App is not obliged to refund any Client that voluntarily exits and ceases to use our features, nor will ByeKids App exact payments from them.
Clients will not use the app to sell or publicize illegal products or activities or establishments that do so as per the UAE law.
Clients will not use ByeKids App to sell spoiled food products or products that may bring harm to consumers. ByeKids App will not be liable for any consequences of such a sale, rather the liability will be on the establishment selling the product.
ByeKids App is primarily a platform to facilitate the flow of information from Clients to potential customers. All information shared is the responsibility of the entities sharing them. ByeKids App is not liable for any of the information shared by third parties using the service or the consequences of that information.
All users agree not to hack into or otherwise tamper with any of our assets, including but not limited to the website dashboard, our servers and the mobile application.
All users Agree not to violate our copyright and trademark of the ByeKids App logo and other trademarked branding assets.
ByeKids App is also not liable for any distortions of the information uploaded by restaurants that occur due to the improper use of the app and website dashboard such as distorted images caused by uploading images of the wrong dimensions or other similar causes.
Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of the UAE, to the exclusion of any other courts without giving effect to its conflict of law’s provisions or your actual state or country of residence Your Comments and Concerns
